Talent Force Drug Policy

1.  Preamble

Talent Force has established a clear and certain commitment to the maintenance of a drug-free work environment.  In support of this commitment, we have adopted and embraced the principle of “zero tolerance” of illegal drugs for employees of Talent Force at all Talent Force facilities and Talent Force client locations. 

This absolute standard of intolerance for illegal drugs has been prompted and required by Talent Force’s concurrent and ongoing obligations to ensure the health and safety of its employees, to maintain an efficient and productive work force, and to protect the health, safety and property of Talent Force clients and their employees.  In support of Talent Force’s firm commitment to a drug-free work environment, the following policy regarding drugs and alcohol shall apply: 

A.  Illegal Drugs Policy

The possession, sale or use of illegal drugs (defined as any drug or drug-like substance – the sale, use or possession of which is unlawful) is inconsistent with Talent Force’s objective of operating in a safe and efficient manner.  Accordingly, no officer or employee who performs duties on Talent Force property or Talent Force business away from Talent Force property, including Talent Force client property or business, shall use, sell or have in his or her possession or control illegal drugs at any time regardless of location.  Additionally, no person noted above shall report to work with illegal drugs at any time regardless of location.  Additionally, no person noted above shall report to work with illegal drugs in his or her system.  Any employee who engages in such conduct will be subject to denial of access to Talent Force property and will be discharged. 

When taking physician-prescribed drugs or over-the-counter legal drugs, which may affect performance, the employee must report such use to his or her immediate supervisor prior to the start of the scheduled work shift for a determination of fitness for duty while on such medication.  An employee’s unlawful involvement with drugs off Talent Force property will constitute grounds for discipline up to and including discharge. 

B.  Alcoholic Beverage Policy

The use of alcoholic beverages by employees is inconsistent with the objective of operating in a safe and efficient manner.  Accordingly, no such person shall use alcoholic beverages during working hours nor shall alcoholic beverages be served at a Talent Force function without prior approval by the appropriate senior officers of the Company as designated by Talent Force’s President/Owner.  Additionally, no such person shall report to work with alcoholic beverages in his or her system.  Persons in violation of this policy will be denied access to Talent Force property and/or disciplined up to and including discharge.  The remainder of the policy sets forth in greater detail the work rules which implement and enforce Talent Force’s anti-drug policy.

II. Drug Screening Procedures

A.  Introduction

It will be the responsibility of each employee to abide by Talent Force’s anti-drug and alcohol policy as part of his or her daily professional work obligations.  In order to ensure compliance with the policy and minimize the risk to safety and efficiency created by persons who subject themselves to practices making them unfit for duty, all applicants for employment by Talent Force will be subject to drug screenings to determine fitness for duty.  The governing conditions under which these persons will be subject to such fitness for duty screening are set forth in the remainder of Section II of the Policy. 

B.  Personnel Subject to Drug Screening

The following persons or personnel are subject to undergoing drug urine screening pursuant to the Talent Force anti-drug policy:

1.  Any employee whose performance or behavior indicates that he or she may be unfit for duty and possibly abusing drugs or alcohol will be subject to drug and/or alcohol screening to determine fitness for duty.

2.  Any employee who is involved in an accident or injury while performing duties on Talent Force property or on Talent Force business away from Talent Force property, including Talent Force client property or business, will be subject to drug and/or alcohol screening to determine fitness for duty. 

III.  Discipline

A. Use, Sale or Possession of Illegal Drugs

The sale or distribution of illegal drugs on or off Talent Force property or the use or possession of illegal drugs on Talent Force property will be grounds for immediate termination and barring from future employment and all Talent Force properties. 

B.  Drug Screening Results

Talent Force employees who undergo fitness for duty drug screening based on their involvement in an accident or injury will be allowed to continue to work pending the results of the screening tests.  If the screening tests produce positive results, the individual will be terminated immediately and permanently barred from future employment with Talent Force and all Talent Force properties.  No drug test results are kept in the employee’s Talent Force file.
